How Financial Services Brands Can Balance Creativity and Compliance

Only 28% of Americans express a great deal or quite a lot of confidence in banks, according to Gallup's 2026 Confidence in Institutions survey. 

Content marketing is one of the clearest tools available to close that gap, but the financial services version of the challenge is harder than most: every claim about a product's benefits, risks, or terms is subject to regulatory scrutiny, and the speed of digital publishing creates conditions where compliance issues emerge before anyone has caught them.

The most common risks include:

  • Misrepresenting product benefits, inclusions, or risks
  • Omitting required disclosures and legal documentation
  • Incorrectly claiming protections such as FDIC insurance
  • Running afoul of CAN-SPAM rules in email marketing
  • Publishing content that inadvertently enables discrimination

The six primary US regulatory bodies covering financial services marketing are the SEC, FINRA, CFPB, FTC, NCUA, and for firms with European operations or customers, GDPR. Most financial brands are subject to more than one simultaneously. The practical framework for getting this right covers four areas:

  • Proactive compliance planning: bring compliance teams into brainstorming, not just final review, so obstacles are identified while concepts are still flexible
  • Pre-approved content templates: standardised review cycles that catch issues during production rather than after a campaign is fully built
  • Thought leadership over direct selling: expert-driven content sidesteps promissory language and positions the brand as a trusted voice on industry topics
  • Educational content: answers to common questions build trust, generate search visibility, and reduce the risk of regulated claims appearing in the copy

On AI, two separate challenges apply. AI-driven compliance monitoring tools can scan content for missing disclosures and risky phrasing at scale, augmenting human review rather than replacing it. AI search is a different problem: financial content is now being summarised in AI Overviews and chatbot answers with no human reviewer in the loop, and there is currently no mechanism for a compliance team to intercept that summary before it reaches a consumer.
